This is an application for bail in connection with Kamtaul P.S.Case No. 12 of 2017 registered for the offences punishable under Sections 392 and 412 of the Indian Penal Code. Allegation as per FIR is that three criminals in a motorcycle, including the petitioner overtook the motorcycle of informant and on the point of pistol they took away his motorcycle and in course of fleeing the villagers chased them and petitioner was arrested but other two accused succeeded in fleeing away. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in custody for six months.

Patna High Court Cr.Misc. No.30979 of 2017 (3) dt.21-07-2017 2/2 Having heard both sides and considering the facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it within nine months by conducting trial on day to day basis and at the same time, Superintendent of Police, Darbhanga is directed to ensure the presence of the witnesses in court so that the trial be concluded within the said period.

With the above observation, this application is dismissed.
