JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and Section 10 of the Bihar Examination Act.

It is alleged that during Post Graduate Examination of Physics paper -V, one Lakshman Kumar was found appearing in place of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner could not appear due to his illness but no seizure has been made to suggest that Lakshman Kumar was appearing in place of the petitioner and even assuming the accusation, at best the case under Section 419 I.P.C is made out against the petitioner. Moreover Lakshman Kumar has been granted bail.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.56060 of 2015 (2) dt.10-12-2015 2/2 surrenders within a period of six weeks in connection with Madhepura P.S. Case No. 506 of 2015, pending in the Court of learned Chief Judicial Magistrate, Madhepura. With the observations above, the application stands disposed off.
