Heard learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 385, 387, 504, 506, 458/34 of the Indian Penal Code and Section 27 of the Arms Act.
It appears that earlier the petitioner had approached this Court for anticipatory bail in Cr. Misc. No. 28877 of 2013 and this Court refused the prayer on 24.12.2013 vide Annexure-1 with direction to the petitioner to surrender in the court below within four weeks from the date of receipt/production of a copy of this order in connection Kotwali P.S. Case No. 38 of 2013 and apply
Patna High Court Cr.Misc. No.36173 of 2017 (2) dt.10-08-2017 2/2 for regular bail on the grounds urged in support of the petition. The petitioner did not comply the aforesaid order nor challenged the same. Therefore, apparently, this exercise of the petitioner is an abuse of the process of the Court. This Court was inclined to dismiss the application with heavy cost. Since no one is appearing on behalf of the petitioner, this application simply stands dismissed in connection with Kotwali Police Station Case No. 38 of 2013 pending in the Court of learned Chief Judicial Magistrate, Patna.
