Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 411, 353/34 of the Indian Penal Code and 174 of the Railway Act.

The prosecution case is that one Niranjan Kumar @ Nirua Mandal was apprehended while committing theft of coal from rail yard. On confession, he named the petitioner as a person who also used to commit theft of coal. It is submitted by the learned counsel for the petitioner that during investigation no material has been come against the petitioner.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before

Patna High Court Cr.Misc. No.55845 of 2015 (2) dt.09-12-2015 the learned court below within a period of six weeks from today in connection with Kahalgaon P.S. Case No. 350 of 2015, pending in the court of learned Chief Judicial Magistrate, Bhagalpur.
