This is an application for bail in connection with Bousi P.S.Case No. 17 of 2017 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of informant along with co-accused persons. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and his whole family members have been made accused in this case. Further submission is that the victim in her statement under Section 164 Cr.P.C. has not stated anything against the petitioner except that he has left her at Delhi and he is in custody for four months. Heard learned APP also.
Patna High Court Cr.Misc. No.35353 of 2017 (3) dt.09-10-2017 2/2 Having heard both sides and in the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.
However, once charge has been framed in this case, learned trial court will release the petitioner on bail to its own satisfaction on the condition that he will co-operate in the trial, if an application for bail is filed on behalf of petitioner. With the above observation, this application is disposed of.
