Petitioner seeks bail in connection with Jamalpur (Bargaun O.P.) P.S. Case No. 33 of 2017 for offences punishable under Sections 302, 304(B), 201, 120(B)/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that her daughter Sabita Kumari was married to Sanjay Mandal and for non-fulfillment of demand of motorcycle the husband and all the in-laws have killed her daughter and cremated the dead body.

It has been submitted by the learned counsel for the petitioner that he is father-in-law of the deceased Sabita Kumari

Patna High Court Cr.Misc. No.35793 of 2017 (3) dt.01-09-2017 2/2 and general and omnibus allegation has been levelled against all in-laws and that no specific allegation against the petitioner. He submits that the deceased fell seriously ill and while taking her to the hospital, she succumbed.

However, learned APP for the State opposes the prayer for bail stating therein that the informant was not informed about the sickness or the death of her daughter.

Considering the facts and circumstances and the materials on record since the petitioner is father-in-law, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, District-Darbhanga in connection with Jamalpur (Bargaun O.P.)
