1. Heard learned counsel for the petitioner and learned APP for the State.

2. A prayer for bail has been made on behalf of petitioner in connection with Ara Town P.S. Case no.224 of 2025 registered under Section 96 of the B.N.S, 2023.

3. The allegations in the F.I.R is that informant's daughter went out to school but did not return. She was searched but she was traceless. Thereafter, the informant got information that the petitioner kidnapped his daughter in order to marry her.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. It is the case of love affair between the petitioner and the daughter of the informant and the same would also be demonstrated by the fact that victim upon her recovery stated in her statement recorded under Section 183 B.N.S.S that she went with the accused out of her own will. It is further submitted that the victim no where alleged any misbehavior on behalf of the petitioner. The petitioner is a young boy and he is in custody since 28.04.2025. The

Patna High Court CR. MISC. No.61381 of 2025(3) dt.15-11-2025 2/2 petitioner has no criminal antecedent and undertakes to cooperate in the case/trial. Charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State who submits that the victim girl is minor and the allegation against the petitioner is of kidnapping. In response, learned counsel for the petitioner submits that the victim is about 17 year of age and hence she has reached the age of discretion and she is capable of taking her own conscious decision.

Taking into consideration the above mentioned facts of the case and also considering the fact that there was mutual love relationship between the petitioner and informant's daughter and the victim in her statement does not disclose any physical abuse etc., at the hand of the petitioner coupled with the fact that petitioner is in custody since 28.04.2025 and has no criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Ara Town P.S. Case no.224 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/Successor Court.
