The petitioner is apprehending his arrest in connection with Maner PS Case No. 410 of 2023, FIR dated 02.06.2023, registered for the offence punishable under Sections 379 and 420 of the Indian Penal Code.

According to prosecution case, some unknown person swapped the ATM card of the informant and withdrew a cumulative amount of Rs. 30,200/- (Rupees thirty thousand and two hundred), made in two different transactions. 4.

Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged is false and fabricated and the petitioner has not committed any such offence as alleged in the FIR.

The learned Additional Public Prosecutor for the State on the other hand has vehemently opposed the prayer for bail of the petitioner on the basis of materials available on record and the case diary and submits that the name of the petitioner has been transpired on the basis of the confessional statement of the person namely, Ranjan Kumar and thereafter, the CCTV footage of that area also suggests that the petitioner was involved in the present crime in question and the petitioner along with the other coaccused persons has committed the crime in question and the motorcycle which was used in the said crime was recovered from the possession of the co-accused person and the said co-accused person has also disclosed the name of the petitioner. 6.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner in connection with Maner PS Case No. 410 of 2023 pending in the Court of Judicial Magistrate 1st Class, Danapur at Patna.
