The petitioner seeks regular bail in connection with Buxar (M) P.S.Case No.126 of 2017 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and under Section 25(1-b)a/26/35 of the Arms Act. Allegation against the petitioner is of recovery of liquor and one country-made pistol.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and though he has criminal antecedent but he is on bail in three cases and in one case he has not been remanded up-till-now.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.42667 of 2017 (2) dt.14-09-2017 Having heard both sides and in view of allegation of recovery of liquor as well as country-made pistol, at this stage, I am not inclined to grant bail to the petitioner, as such this application is disposed of with direction to the learned trial court to expedite the trial of the petitioner and if the trial is not concluded within a period of four months, he shall release the petitioner on bail in connection with Buxar (M) P.S.Case No.126 of 2017 to his own satisfaction.
With the aforesaid observation, this application is disposed of.
