This is a petition for grant of anticipatory bail for offence under Sections 363, 366A, 366, 504 and 506/34 of the Indian Penal Code.
Petitioners are suspected to have kidnapped Jaimala Kumari, the sister of the informant. The victim girl in her statement under Section 164 of Criminal Procedure Code stated that she had voluntary gone with co-accused, Prakash Kumar, and she has already married with Prakash Kumar.
Considering the statement of the victim girl, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Harsidhi P.S. Case No. 82 of 2016 to the satisfaction of the Chief Judicial Magistrate, Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
