JUSTICE ARUN KUMAR ORAL ORDER 20-09-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sastrinagar P.S.Case No. 403 of 2017 registered under Sections 387 and 120B/34 of the Indian penal Code. Allegation in brief is that one Harendra Singh along with his associates including the petitioner came to the Electricity Office and tried to disturb the opening of the tender of the Department and some persons were apprehended at the spot but not this petitioner.

Submission is that this petitioner is made accused only on the basis of confessional statement of one of the apprehended accused, except that there is no material against him and he has got no criminal antecedent and other co-accused, similarly situated, has been granted regular bail by a co-ordinate bench of

Patna High Court Cr.Misc. No.43203 of 2017 (2) dt.20-09-2017 2/2 this Court vide order dated 19.09.2017 passed in Cr. Misc. No. 44349 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Avinash Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Manish Prasad, J.M>, 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 403 of 2017.
