The petitioner, namely, Ashok Ram @ Garden, is in custody in Paliganj P.S. Case No. 142 of 2014 under Sections 302, 201 and 34 of the Indian Penal Code.
The learned counsel for the petitioner submitted that there is general and omnibus allegation against the petitioner that kerosene oil was poured on the deceased i.e. wife of the petitioner. On the other hand, learned A.P.P. objected the prayer for bail.
Perused the F.I.R. According to the F.I.R., all the accused persons were taking the dead-body for cremation and when the informant party came there after getting information, the accused persons fled away. The District Judge from the Case
Patna High Court Cr.Misc. No.55744 of 2015 (2) dt.16-12-2015 Diary found that the witnesses in paragraph Nos. 8, 9, 15, 16, 17, 18 and 19 supported the fact that the petitioner set fire on his wife. At paragraph No. 10 of the bail application, the petitioner admits that there was quarrel between the petitioner and his wife and the lamp fell down and as a result of which, fire was caught in the synthetic saree.
Considering the above facts and circumstances and the nature of allegation, in my opinion, it is not a fit case for grant of bail. Accordingly, this application stands rejected. Brajesh/- (Mungeshwar Sahoo, J.) U T
