19-08-2017 Heard Sri Vibhakar Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 13-07-2017 in Lakhisarai P.S. Case No. 279 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(i), 41(i) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

Learned counsel for the petitioner submits that falsely, he was apprehended on chase, as if, petitioner alongwith other two accused after noticing police threw a bag containing huge quantity of country-made foreign liquor of Jharkhand and on chase, only petitioner was arrested. Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.39636 of 2017 (2) dt.19-08-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Vikki Paswan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II -cum- Special Judge, Lakhisarai in connection with Lakhisarai P.S. Case No. 279 of 2017.
