This is an application for bail in connection with Bheldi P.S. Case No. 35 of 2015, registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. Petitioner is husband and the case is under Section 304B IPC.
Submission of learned counsel for the petitioner is that as a matter of fact while preparing food her sari caught fire and she was taken to hospital and her statement was recorded in hospital and she has not supported the prosecution case and he is in custody since 23.5.2017.
Heard learned APP also, who has opposed the prayer for bail stating that independent witnesses during course of
Patna High Court Cr.Misc. No.43673 of 2017 (4) dt.06-11-2017 2/2 investigation has supported the prosecution case and death is under in abnormal circumstance.
Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it within a period of nine months.
