JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the State. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 30.03.2017, passed in Cr. Misc. 9233 of 2017.

It has been submitted that petitioner is in custody since 29.11.2016. The charge has now been framed against this petitioner for the offence under Section 302/34 of the Indian Penal Code by order dated 15.07.2017 passed by the court below. In the written report there is allegation against the petitioner of shouting that Nagendra Mahto should not remain alive. Except this, there is no specific allegation against the petitioner.

In such circumstances, keeping inn view the period

Patna High Court Cr.Misc. No.41968 of 2017 (3) dt.20-09-2017 2/2 spent by the petitioner in custody and charge has already been framed, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-X, Saran at Chapra, in connection with Sessions Trial No. 130 of 2017 arising out of Khaira P.S. Case No. 181 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
