The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 30 bottles each containing 300 ml, i.e., 9 litres of Nepali liquour were recovered from a bag kept on the motorcycle which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 22.05.2017. Considering the facts and the circumstances of the

No.34437 of 2017(2) dt.10-08-2017 2/2 case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II, Sitamarhi in connection with Bela P.S. Case No. 128 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
