The petitioner apprehends his arrest in connection with Gangabridge P.S. Case No. 07 of 2021 registered under Sections 30(a)/36/41(1) of the Bihar Prohibition and Excise Amendment Act.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further he submits that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer for anticipatory bail of the petitioner by contending that there is direct allegation against the petitioner. The petitioner is owner of the alleged truck and
Patna High Court CR. MISC. No.59669 of 2022(4) dt.23-02-2023 2/2 huge quantity of IMFL has been recovered from the said truck. Hence, this is not a fit case for grant of anticipatory bail. Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
