In this case, the petitioner is challenging the order dated 6.10.2015 passed by the learned Sessions Judge, Muzaffarpur in Sessions Trial No. 490 of 2015 arising out of Saraiya P.S. Case No. 375 of 2013 (G.R. No. 2946 of 2013), whereby and whereunder, the court below has been pleased to dismiss the application filed under Section 228 of the Cr.P.C. and thereby charge under Section 307 of the Indian Penal Code has been framed against the petitioner.

The court below has well discussed the matter in the

Patna High Court Cr.Misc. No.1307 of 2016 (2) dt.09-08-2016 impugned order itself and has also mentioned about the nature of allegation and involvement of the petitioner in the offence.
