The petitioner seeks regular bail in Piro(Hassan Bazar P.S. Case No.85 of 2017 registered for the offences under Sections 379, 411, 414/34 of the Indian Penal Code. Allegation as per the F.I.R. against the petitioner is that during course of checking the petitioner and two co-accused persons were caught hold on motorcycle and they could not show any paper of the motorcycle and one accused person out of them fled away.

Submission of the learned counsel for the petitioner is that he has clean antecedent and he has falsely been implicated in this case. Other accused persons, namely, Mantosh Kumar and Ravi Kumar vide have already been granted bail vide order dated

Patna High Court Cr.Misc. No.35186 of 2017 (2) dt.04-08-2017 2/2 12.7.2017 and 20.7.2017 passed in Cr.Misc. No.31385 of 2017 and Cr.Misc. No.32813 of 2017 respectively. The petitioner is in custody for four months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances and other co-accused have already been granted bail, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara, in Piro (Hassan Bazar) P.S. Case No. 85 of 2017, subject to the conditions that (i) one of the bailers of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) The petitioner will not induce any witness or tamper with the evidence. (iii) The petitioner shall cooperate in the disposal of the trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
