The petitioner seeks regular bail in Shambhuganj P.S. Case No.103 of 2016 for the offence under Sections 376, 323, 506 of I.P.C. and 4, 8 and 12 of the POCSO Act.

Earlier prayer for bail of the petitioner was rejected vide order dated 9.1.2017 passed in Cr.Misc.No.54675/16 which was dismissed by this Court on merit.

Submission of the learned counsel for the petitioner is that he is in custody for a year and the trial has not yet commenced.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that once prayer for bail of the petitioner has already been rejected, I am not inclined to grant bail to the petitioner. However, trial court is

Patna High Court Cr.Misc. No.36725 of 2017 (3) dt.23-08-2017 2/2 directed to expedite the trial in view of the fact that the petitioner is in custody for one year and conclude as soon as possible preferably within one year and if the trial is not concluded within the aforesaid period, petitioner will be at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
