The petitioner seeks pre-arrest bail in connection with Aurangabad (T) P.S. Case No. 205 of 2019 for the offences alleged under Sections 370 and 374 of the Indian Penal Code, 79 of the Juvenile Justice Act and 14(1) of the Child Labour Act.

In course of raid at Harsh Chicken Center of the petitioner, a minor boy, Mandeep Kumar, child labourer, was found cleaning the utensils.

The submission of the learned counsel for the petitioner is that in fact Mithilesh Kumar, resident of village Kasmar, P.S. Tarhansi, Plamau, Jharkhand, co-villager of Mandeep Kumar used to do the work of labourer at Harsh

Patna High Court CR. MISC. No.58273 of 2019(2) dt.16-09-2019 2/2 Chicken Center of the petitioner and Mandeep Kumar had gone to meet him, but, the informant, without verifying the same, lodged the present case against the petitioner. Petitioner has no criminal antecedent.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Aurangabad (T) P.S. Case No. 205 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
