The petitioner, Parmanand Sharma, is in custody in Janki Nagar P.S. Case No.59 of 2015 under Section 363, 366A/34 of the Indian Penal Code.
The learned counsel for the petitioner submitted that the allegation is that Sunil Kumar Sharma including the petitioner and other co-accused persons abducted the daughter of the informant. According to the learned counsel, in fact Sunil Kumar Sharma had married the girl. As both of them were in love since prior to the occurrence. The co-accused, Mahavir Sharma, the case of which is on same footing has already been granted bail by this Court in Cr. Misc. No.39201 of 2015 on 09.09.2015.
Patna High Court Cr.Misc. No.55757 of 2015 (2) dt.17-12-2015 2/2 Perused the order passed by this Court granting bail to Mahavir Sharma and the allegation made in the FIR. It appears that the alleged victim girl gave her statement under Section 164 showing her age and that she has already been married with Sunil Kumar Sharma.
Considering the above fact, I direct that the above named petitioner be released on bail on furnishing bail bond of Rs.5,000/- (five thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist, Purnea in connection with Janki Nagar P.S.
