1. Having heard the learned Advocate appearing on behalf of the petitioner and the learned counsel for the State Respondents, this Court finds that the petitioner has approached this Court for issuance of writ of mandamus, directing the Respondent Authority to fix his pay-scale, giving relief of 2nd A.C.P.

2. It is contended by the learned counsel for the Respondents that prior to filing of the instant writ, the petitioner did not file any representation before the concerned authority for revision of his pay-scale. Without such representation, prayer for issuance of mandamus is not maintainable.

3. This Court conquers with the view of the learned counsel for the Respondents.

4. The instant writ petition is disposed of, being premature, with a liberty to the petitioner first to file a representation before the concerned authority. If any adverse order is passed by the concerned authority, the petitioner is at liberty to take appropriate action in accordance with law.
