The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (A) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 189 litres of Nepali soufi wine were recovered from the vehicle which was being boarded by three persons including the co-accused Raja Bhanu who in his confession disclosed the name of the petitioner and there is no recovery from the petitioner. Petitioner
Patna High Court Cr.Misc. No.36404 of 2017(2) dt.10-08-2017 2/2 claims that he is having clean antecedent and is in custody since 22.06.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-I/c Special Judge, Excise Act, Sitamari in connection with Sonbarsa P.S. Case No. 128 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
