The petitioner seeks bail in connection with Bakhtiyarpur (Balwa Hat O.P.) P.S. Case no. 123 of 2017 registered under Sections 392 and 414 of the Indian Penal Code. Three motorcycles borne criminals are said to have looted cash, mobiles of the informant and his brother and motorcycle of the informant on the point of firearm.

It is submitted by the learned counsel for the petitioner that the petitioner is not named in the F.I.R. Nothing incriminating article has been recovered from his conscious physical possession rather the looted mobiles were recovered from the possession of the accused Chandan Sah and the stolen motorcycle was recovered at the door of accused Nagendra Yadav. Considering the facts and circumstances of the case, let above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri S.K. Modi, C.J.M., Saharsa in connection with Bakhtiyarpur (Balwa Hat O.P.) P.S. Case no. 123 of 2017.
