JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447, 341, 323, 354B, 504 and 506/34 of the Indian Penal Code and Section 3/4 of the Prevention of Witch (Daain) Practices Act.

The prosecution case is that the accused persons addressed the informant as a witch as they are under believe that the informant has practiced witch craft on the grand-daughter of the petitioners and on protest being made, petitioner no.2 tried to outrage the modesty of the informant when petitioner no.1 directed to lift the informant.

It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.56199 of 2015 (2) dt.10-12-2015 2/2 for the petty dispute, the accusation has been levelled. For the occurrence of 18.05.2015 at 8 PM the FIR was lodged on 19.05.2015 at 11.10 AM which reached to the court of learned Incharge CJM on 21.05.2015 which reflects that by antedating the FIR was registered. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran in connection with Rajepur P.S. Case No. 60 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
