This application is for grant of regular bail in connection with Halsi (Ramgadh Chowk) P.S.Case no.136 of 2018 dated 27.8.2018 for the offences under Sections 376/511 of the Indian Penal Code and Section 8 fo the POCSO Act.. There is allegation against the petitioner of attempt of rape on the seven years daughter of the informant. Submission of the learned counsel for the petitioner is that the materials collected during the investigation discloses that there was enmity between them and the informant had threatened to implication the petitioner. Petitioner is in custody since 29.9.2018 . Charge has already been framed. On the other hand the learned APP has opposed the prayer for bail stating that the girl in her statement under
Patna High Court CR. MISC. No.58160 of 2019(4) dt.06-02-2020 2/2 Section 164 of the Cr.P.C. has supported the prosecution case. Heard learned A.P.P. also.
Having heard both sides and considering the submissions as made above, I am not inclined to grant bail to the petitioner at this stage, however, since the petitioner is in custody for more than one year and the charge has been framed. Learned trial court is directed to expedite the trial and conclude it as expeditiously as possible.
With the aforesaid observation, this application is dismissed.
