JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Asawan P.S. Case No. 26 of 2017, registered for offences punishable under Sections 272, 273 and 308 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 43 litres of foreign liquor. It has been submitted on behalf of the petitioner that nothing has been recovered from his possession and he has been made accused in this case only on the basis of suspicion and he has no criminal antecedent and has remained in judicial custody for three months.

Having heard both sides, considering the facts and

No.37836 of 2017 (4) dt.24-08-2017 circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II, Siwan, in connection with Asawan P.S. Case No. 26 of 2017. It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
