The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 326 and 307/34 of the Indian Penal Code. The petitioner alleged to have assaulted the informant and his brother with Fasuli.

It is submitted by learned counsel for the petitioner that there is a counter version of the occurrence and the injury report is not on the record.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail provisionally for three months, in the event of his arrest or

Patna High Court Cr.Misc. No.55914 of 2015 (2) dt.09-12-2015 2/2 surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Khizer Sarai P.S. Case No. 297 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below on verification of the fact that no grievous injury has been received either by the informant or his brother, but if it is found that the informant or his brother has received grievous injury then the petitioner will surrender and pray for regular bail.
