The petitioner is in custody since 06.08.2019 in connection with Patori P.S. Case No. 218/2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recovery has been made from the abandoned house and not from the conscious possession of the petitioner. It is further submitted that the petitioner has been falsely implicated in connection with the present case and he is on bail in connection with one such other case under the Excise Act.

In view of the aforementioned facts and

No.58271 of 2019(2) dt.24-09-2019 2/2 circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum Special Judge, Excise, Samastipur, in connection with Patori P.S. Case No. 218/2019.
