JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

During course of repairing of house by the informant Bajrangi Paswan, petitioner Ghanshyam Paswan appeared and forbidden which has been resisted by the informant and in the aforesaid background, Ghanshyam Paswan armed with pointed rod, his sons Vishal Paswan and Aakash Paswan armed with lathi came out of whom, Ghanshyam Paswan gave rod blow over his head. When his daughter Deji Kumari came in rescue she was abused, assaulted and during course thereof, Aakash Paswan molested. From the order impugned, it is evident that the doctor had found three injuries over his head having dimension 1"x1/4"x skin deep over parietal reason which has been found simple. The doctor had also found injury over shoulder which, after X-ray, has been found grievous on account of fracture and for that, petitioner is not at all responsible.

No.40274 of 2017 (2) dt.21-09-2017 That being so, petitioner Ghanshyam Paswan is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.
