JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Riga P.S. Case No. 139 of 2016 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of the Arms Act. The allegation against the petitioner is that one loaded country made pistol and one Intex Mobile Phone were recovered from the conscious possession of the petitioner. It has been submitted on behalf of the petitioner that two co-accused, namely, Dhiraj Kumar and Sujit Kumar having similar allegation have already been granted bail by another coordinate Bench of this Court vide orders dated 21.11.2016 and

Patna High Court Cr.Misc. No.53943 of 2016 (2) dt.15-12-2016 2/2 22.11.2016 in Criminal Miscellaneous Nos. 50259 of 2016 and 50358 of 2016 and the petitioner is in custody since 05.07.2016. Heard the learned APP also.

Having heard both sides, in view of the fact that two co-accused having similar allegation have already been granted bail by this Court, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 139 of 2016.
