In the present case, the petitioner is submitting that he was appointed and worked as Assistant Engineer in the Road Construction Department in the State of Gujarat and later on, he has been selected and appointed in the State of Bihar. The claim has been made by the petitioner that the period he has spent in the State of Gujarat should be reckoned in the present service for the purposes of pensionary benefit and pay protection. It has further been submitted that the matter has not finally been decided by the State of Bihar, he has shown the noting of the Government wherein in some places, it has been shown that he can be given the
Patna High Court CWJC No.16002 of 2012 dt.14-05-2019 2/2 benefit for the said period, but ultimately as has been informed that no decision has been taken by the Government. Let the State Government take a final decision in the matter.
However, it is made clear that this Court is not giving any opinion on the merit of the case.
With the aforesaid observation and direction, this writ petition stands disposed of.
