Petitioners seek regular bail in a case registered for the offence punishable under Section 364, 302 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, brother of informant, who was slept in the new house, was found missing in the morning leading to registration of FIR against unknown. Learned counsel appearing for the petitioner submits that petitioners are not named in the FIR. The names of petitioners were taken by the informant raising a suspicion against them after three months of occurrence on the ground
Patna High Court CR. MISC. No.71648 of 2021(3) dt.24-03-2022 2/2 that there was some money dispute between the deceased and these petitioners and except suspicion there is no other material against these petitioners to show their complicity in the aforesaid crime. Petitioners claim clean antecedent and are in custody since 05.10.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar OP) PS case No.345/2019.
