The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

Accusation is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 15 years, the Court also assessed her aged 15 years. She has also stated that she was sedated by this petitioner and asked her to marry. Subsequently, the petitioner left the victim near Bettiah Police Station.

Patna High Court Cr.Misc. No.55873 of 2015 (2) dt.09-12-2015 petitioner that 164 Cr.P.C. statement reflects that the victim of her own went to the company of the petitioner and no misbehaviour has been alleged against him.

Considering the fact that the victim is found minor, this Court is not inclined to grant anticipatory bail to the petitioner in connection with Sikta P.S. Case No. 79 of 2015, pending in the Court of learned Shri Jitesh Kumar, J.M. Ist Class, Bettiah, West Champaran.
