The present appeal is directed against the order dated 25.11.2021, passed by learned Additional Sessions Judge III, cum Special Judge, SC/ST Act, Patna in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 3 (2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, whereby regular bail of the appellant has been rejected. Earlier prayer for bail of the appellant was rejected on 15.4.2021. Appellant has renewed his prayer for bail on the
Patna High Court CR. APP (SJ) No.5 of 2022(3) dt.23-03-2022 2/2 ground of parity. Learned counsel for the appellant submits that similarly situated co-accused Lalu Yadav has already been allowed bail by a co-ordinate bench of this Court vide Annexure
3. appellant is in custody since 17.9.2020.
Considering the period of custody of the appellant and the fact that similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court, during pendency of the appeal, let the appellant above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III cum Special Judge, SC/ST Act, Patina in Paliganj Police Station Case No. 122 of 2019.
