JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-08-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has prayed for bail in connection with Pachrukhi P.S. Case No. 110 of 2021 instituted for the offence under Sections 147, 341, 323, 307 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he fired upon the mouth of the informant's son due to which he sustained fire arm injury and the reason behind this alleged occurrence is said to be land dispute.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.61382 of 2022(6) dt.02-08-2023 2/3 that petitioner has been falsely implicated in this present case. It is also submitted that there is delay of 3 days in lodging the FIR. It is also submitted that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 16.08.2022.
Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail and submitted that the petitioner is named in FIR. A counter affidavit has been filed on behalf of the informant by referring to the statement made in para-4 that the injury sustained to the injured on his mouth, is grievous in nature and caused by fire-arm. The injured is not able to open his mouth and his treatment is still going on and in support of this, Annexure-1 series of the counter affidavit has been annexed in this petition. It is also submitted that there is specific overt act of firing upon the informant's son against the petitioner.
Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
