JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 11(1)(d), 11(1)(k) of Prevention of Cruelty to Animals Act, 1960.

One person was intercepted carrying animals to Nepal who disclosed his name as Kasim and confessed that animals were being supplied by this petitioner for being taken to Nepal.

It is submitted by learned counsel for the petitioner that even assuming the accusation neither any offence under 414/34 I.P.C nor under the Prevention of Cruelty to Animals Act are made out against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the

No.56271 of 2015 (2) dt.11-12-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Manpur P.S. Case No. 36 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
