JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 24-11-2022 The petitioner has prayed the following relief(s):- (I) To quash the memo no. 1383 dated 11.08.2022 issued by the District Education Officer, Madhepura whereby and whrerunder direct to the Employment Unit for cancellation of appointment of the petitioner on the basis of his training certificate issued from the Sister Nivedita College, Calcutta is not valid. A copy of memo dated 11.08.2022 is annexed hereto and marked as Annexure-1 to this application. (II) To further direct the respondent authority to pay the salary of the petitioner since 01.01.2021 to till date.

(IV) To further direct the respondent not to disturb the petitioner in discharging his duty as Block Teacher in Anirudh Middle school, Gamail Block, Bihariganj, Madhepura. Considering it that this matter is covered by the judgment, dated 23.02.2022 passed in C.W.J.C. No. 5489 of 2020 (Suresh Ram Vrs. The State of Bihar & Ors.) and connected matters reported in 2022(2) B.L.J., 381, 2022 (2) PLJR, 80 and the judgment dated 07.03.2022, passed in C.W.J.C. No.34 of 2022 (Minakshi @ Sushre Minakshi & Ars. Vrs. The State of Bihar & Ors), this petition is disposed of with the above terms.

If an appeal is preferred before the District Appellate Authority/State Appellate Authority the same shall be taken up at the earliest and preferably decided within a period of six months.
