The petitioner seeks bail in connection with Bachhwara P.S. Case No. 59 of 2021 instituted for the offences under Section 30(a) (d) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 31.07.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the allegation is of recovery of 80 litres of liquor from a maize field along with 1000 litres of raw materials for manufacturing liquor. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and was identified by

Considering the fact that the petitioner is in custody since 31.07.2021, charge-sheet has been submitted in the case, was not arrested from the spot and his name was disclosed by the Choukidaar, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Bachhwara P.S. Case No. 59 of 2021.
