This is an application for bail in connection with Vibhutipur P.S.Case No. 07 of 2017 registered for the offences punishable under Sections 414 of the Indian Penal Code and 25(1B)(A), 26 & 35 of the Arms Act. Allegation as per FIR is of recovery of one carbine and further petitioner has criminal antecedents and he has been made accused in seven other cases.
Submission of learned counsel for the petitioner is that the impugned order itself shows that the recovered carbine was not found in working condition and though he has been made accused in seven other cases but he is on bail in those cases. Heard learned APP also.

No.36994 of 2017 (3) dt.30-08-2017 2/2 Having heard both sides and in view of facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Samastipur, in connection with Bibhutipur P.S.Case No. 07 of 2017, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall appear in police station every month till the disposal of case, failing which his bail bond shall be cancelled.
