The petitioner is in custody since 11.07.2017 in connection with Sonepur (Hajipur) Rail P.S. Case NO. 42 of 2017 for the offence registered under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that neither the petitioner named in the first information report nor has there been any recovery from the conscious possession of the petitioner. It is further submitted that the petitioner has been taken into custody only because the motorcycle was recovered near the garage of the petitioner with which he has no concerned.

No.40752 of 2017 (2) dt.19-09-2017 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has got clean antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., (Railway) Sonepur, Saran in connection with Sonepur (Hajipur) Rail P.S. Case No. 42 of 2017.
