The petitioner seeks bail in a case initially registered for the offence punishable under Section 392 of the Indian Penal Code. The learned counsel for the submits that after investigation charge-sheet was submitted under Sections 395 and 412 of the I.P.C.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2017, charge-sheet has been submitted in this case and has antecedent of one case. The learned counsel for the petitioner submits that the informant alleges that four unknown criminals after duping, took his truck loaded with iron angles.

The learned counsel for the petitioner submits that the

It is further submitted that petitioner, despite in custody, was not put on T.I.P., nor any incriminating article was recovered from his possession to connect him even remotely with the offence.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and was not put on T. I. Parade, nor any incriminating article has been recovered from his possession, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Didarganj P. S. Case No.105 of 2017, subject to condition that one of the bailors shall be the cousin brother of the petitioner namely, Chandan Kumar.

The application stands allowed.
