The petitioner seeks regular bail in connection with Madhuban P.S.Case No.71 of 2017 registered for offences punishable under Sections 387 and 120(B) of the Indian Penal Code and Section 17 C.L.A. Act and Seciton 10/13 U.A.P.A. Act. Allegation against the petitioner as per FIR is of demand of extortion of Rs.07 lakh by one Sunny Singh (Rajput) on the mobile and it is further alleged that the petitioner is one of the members of that gang.

Submission of the learned counsel for the petitioner is that he is been falsely implicated in this case and he has nothing to do with the said extortion. The petitioner has no criminal antecedent and he has remained in custody for about 2 1⁄2 months.

Patna High Court Cr.Misc. No.42129 of 2017 (3) dt.10-10-2017 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the fact that no specific role has been assigned in the FIR against the petitioner and he has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 4th, Motihari in connection with Madhuban P.S.Case No.71 of 2017.

With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
