1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Arwal Police Station Case No. 160 of 2025, dated 05.05.2025, disclosing offences under Sections 191(2)/191(3)/190/126(2)/115(2)/303(2)/109/117(2)/352/ 351(2) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report, is that on 02.05.2025, at about 8:00 P.M., when the informant's father had gone to take chuna from a nearby shop, the co-accused Sushil Kumar abused him in
2/4 indecent language, which the informant's father objected and returned home. The petitioners, along with other coaccused persons, armed with weapons chased him and started assaulting him and his family members. When the informant intervened, the petitioner no. 3 assaulted the informant with rod on his head, causing fracture injury and also informant's sister on her arm due to which her arm got fractured. It has further been alleged that the accused persons assaulted the family members of the informant and took away ornaments worth of Rs. 50,000/-.
4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due to village politics. The allegations against the petitioners are general and omnibus in nature except against the petitioner no. 3 of assault on victims, however, the injuries caused to them are simple in nature. He next submits that a counter case has also been lodged by the side of the petitioners, bearing Arwal SC/ST Police Station Case No. 05 of 2025, for the occurrence which took place on 02.05.2025, against the informant and others. He further submits that both the parties have
3/4 arrived at compromise and a petition in this regard has already been filed before the Chief Judicial Magistrate, Arwal, on 09.06.2025. The similarly situated co-accused persons have been granted anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 57212 of 2025.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that allegations against the petitioners are general and omnibus in nature, injuries sustained by the victims are simple in nature and similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, Jehanabad, in connection with Arwal Police Station Case No. 160 of 2025, subject to the
4/4 condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
