JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Suryapura P.S. Case No. 30 of 2017 for the offence under sections 461, 379, 411 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he was involved in selling and purchasing of stolen buffalo. Submission on behalf of the petitioner is that the alleged stolen buffalo was not recovered from his possession and he is quite innocent and he has no criminal antecedent. Having regard to the fact that the petitioner has stated in paragraph-3 of the petition that he has no criminal antecedent and the fact that the allegation against the petitioner is that he was instrumental in selling and purchasing of the stolen

Patna High Court Cr.Misc. No.35993 of 2017 (2) dt.10-08-2017 2/2 buffalo, although, nothing was recovered from his conscious possession, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bikramganj at Rohtas in connection with Suryapura P.S. Case No. 30 of 2017 on the condition that the petitioner will extend full cooperation in this case and will not, in any manner, tamper with the evidence or influence the witnesses.
