JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This is an application for grant of anticipatory bail in connection with Bangaon P. S. Case No. 09 of 2019, disclosing offences under Sections 304/34 of IPC.

Prosecution case is that petitioner and other have intentionally dashed the father of the informant, causing injury, due to which, he succumbed injuries.

Submission of the learned counsel for the petitioner is that the F.I.R. also suggest that vehicle was driven by one Rahul Rao, who was arrested at the spot also and he is only sitting in the vehicle. Further submission is that he has falsely been implicated in this case, having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

No.59399 of 2019(2) dt.19-09-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Saharsa, in connection with Bangaon P. S. Case No. 09 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
