The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366, 366A and 34 of the Indian Penal Code read with Section 8 of the POCSO Act. Learned counsel for the petitioner submits that the petitioner is in custody since 01.05.2021, charge-sheet has been submitted in the case and has antecedent of two cases. The informant alleges that his minor daughter aged about 15 years was kidnapped by the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, victim has come back and has not supported the prosecution case in her

Patna High Court CR. MISC. No.71775 of 2021(2) dt.11-05-2022 2/2 statement made under Section 164 of the Cr.P.C. and in support of the same, the learned counsel for the petitioner relies on paragraph '116' of the bail application and the said submission of the learned counsel for the petitioner was also confirmed by the learned A.P.P. for the State who was handed over the case diary by the learned counsel for the petitioner. Considering the fact that the petitioner is in custody since 01.05.2021, charge-sheet has been submitted in the case and victim has not supported the prosecution case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with POCSO Case No. 18 of 2021 arising out of Saharsa P.S. Case No. 335 of 2021.
