JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hulasganj P.S. Case No. 91 of 2017 registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor daughter of the informant and further it appears that in her statement under Section 164 Cr.P.C. the victim girl has supported the allegation and she has stated her age as 15 years. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the allegation is false and concocted.

Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court CR. MISC. No.57305 of 2019(2) dt.11-09-2019 2/2 petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
