12-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with complaint case no. 704(C)/2014 registered for the offences punishable under Section 498A of the Indian Penal Code. Learned counsel for the petitioner submits that there is general and omnibus allegation and the petitioner no. 1 being the Bhainsur has tried to convince the younger brother husband of the informant to stay with his wife with all honour and dignity. Learned counsel for the informant submits that actually

Patna High Court Cr.Misc. No.57531 of 2015 (2) dt.12-01-2016 2/2 her husband was married with another girl and therefore the question of living with the husband does not arise. Petitioner no. 1 being the Bhainsur, petitioner no. 2 being the Gotni of the informant, petitioner no. 3 being the Devar have thus, no role to play and may be extended the privilege of anticipatory bail. Considering the afore-mentioned facts and circumstances and the nature of allegation against these petitioners, let the petitioners, above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Complaint Case No. 704 (C)/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
